Terms of Service
1.1. These Terms of Service (the “Terms”)govern your use of the services from Safestate AB. Byaccepting these Terms, either by clicking a box or button indicating youracceptance or by executing an order form or other document referring to theseTerms, you agree that these Terms form part of the agreement for your use of the service(the “Agreement”). You may be (i) a direct customer who haspurchased a subscription directly from Safestate.com (a “Customer”), (ii) an authorizedSafestate reseller (a “Reseller”), or (iii) an end user of the SafestateService (as defined below) with a subscription managed by a Reseller (an “EndUser”).
1.2. These Terms were last updated on August21, 2023 and are effective between you and Safestate AB as of the date when youaccept these terms as described above. Safestate reserves the right to changethese Terms from time to time. If such changes are considered material,Safestate will inform registered Customers, Resellers, and End Users about thechanges by email, and the changes will take effect one month after such emailshave been sent. Your continued use of our website or services after such changeswill constitute acknowledgment and acceptance of the modified Terms.
1.3. In case of any discrepancies between thewording of our website and these Terms, these Terms prevail. Any additional ordifferent terms or conditions proposed by you (whether by order, purchaseorder, counteroffer, acknowledgement, electronic data interchange, orotherwise) are hereby expressly objected to and will not be in any way bindingupon Safestate.
1.4. These Terms as well as all other textsthroughout the website and/or services may be translated from English to otherlanguages. These are unofficial translations and are only provided asconvenience translations. They should therefore be interpreted in accordancewith their English language versions which will prevail in the event of anydiscrepancy between the English version and the translation. Safestate assumesno liability for any errors, omissions, or ambiguities in the translations. Anyperson or entity choosing to rely on the translated content does so at theirown risk. When in doubt, please always refer to the official English languageversion.
2.1 By visiting our website and accessing theinformation, resources, services, products and tools we provide for you, both free and payable,either directly or indirectly (the “Resources”), you agree to use these Resources only for the purposes permitted by (a) these Terms and(b) applicable laws, regulations.
2.2 Wherein, you understand that:
• In order to access our Resources, you may be required to providecertain information about yourself (such as identification, contact details,etc.) as part of the registration process or as part of your ability to use theResources. You agree that any information you provide will always be accurate,correct and up to date.
• You are responsible for maintaining the confidentiality of anyinformation associated with the service. Accordingly, you are responsible forall activities that occur under your activity(s).
• You may only permit authorized users to access information, and youmust ensure that anyone who uses the Resources does so only for your authorizeduse and complies with these Terms.
• You may not make the Resources or any information available to anythird party, including, without limitation, in any form by rental, servicebureau, hosting, time sharing arrangement or demonstration of the Resources toany third party. You may not use the Resources for the benefit of a thirdparty. You may not disclose to any third party the results of any benchmarkingor comparative study or analysis involving the Resources.
• Accessing (or attempting to access) any of our Resources by any meansother than through the means we provide is strictly prohibited. Youspecifically agree not to access (or attempt to access) any of our Resourcesthrough any automated, unethical, or unconventional means.
• Engaging in any activity that disrupts or interferes with ourResources, including the servers and/or networks at which our Resources arelocated or to which they are connected, is strictly prohibited.
• This includes restricting in any way any other authorized user fromusing the Resources. We may suspend your use of the Safestate Services if youruse causes or is reasonably likely to cause damage to the Safestate Service oranother customer.
• Attempting to copy, duplicate, reproduce, sell, trade, or resell ourResources is strictly prohibited unless otherwise agreed in writing.
• The Resources may not be used in any way that is unlawful or whichharms Safestate (or its thirdparty licensors) or the Safestate Service asdetermined by Safestate in its sole discretion.
• You must use your best efforts to cooperate with and assist Safestatein identifying and preventing any unauthorized use, copying or disclosure ofthe Resources or any portion thereof.
• If you learn of any actual or threatened infringement of the Resourcesthrough piracy, or if any piracy or infringement claim is made against you by aparty other than Safestate in connection with your use of the Resources, youmust notify Safestate as soon as possible.
• You are solely responsible for any consequence, loss or damage whichSafestate may directly or indirectly incur or suffer due to any unauthorizedactivities conducted by you as described above and which may incur criminal orcivil liability.
2.3 We may provide various opencommunication tools on our website, such as a help desk, public chat, productratings and reviews, etc. You understand that we do not generally pre-screen ormonitor the content posted by users of these various communication tools whichmeans that if you choose to use these tools to submit any type of content toour website it is your personal responsibility to use these tools in aresponsible and ethical manner. By posting information or otherwise using anyopen communication tools as mentioned, you agree that you will not upload,post, share or otherwise distribute any content that is; illegal, threatening,defamatory, harassing, degrading, intimidating, fraudulent, deceptive,invasive, racist or contains any type of improper or inappropriate language.Infringes on any trademark, patent, trade secret, copyright, or otherproprietary right of any party. Contains any type of unauthorized orunsolicited advertising; or Impersonates any person or entity, including anySafestate employees or representatives.
2.4 We have the right to remove at oursole discretion any content that we find in our judgment does not comply withthese Terms along with any content that we find to be otherwise offensive,harmful, objectionable, inaccurate or in violation of any third-partycopyrights or trademarks. We are not responsible for any delay or failure inrelation to the removal of such content. If you post content that we choose toremove, you hereby consent to such removal, and you also consent to waiving anyclaim against us.
2.5 We do not assume any liability forany activity by you or any other third-party users of our website andservices.
To use the services the end-user may need toprovide information. This information ma be provided in several different ways,either (i) end-user provide it, or (ii) the reseller provides it. This dependson how the end-user have gained access to the services.
Depending on which way Safestate AB isreceiving the information different time limitation may be applied on how muchtime the end-user has to add information.
What kind of information that is neededdepends on what service that will be activated. What information are statedunder each service description below.
After Safestate AB have received theinformation, the services are activated, if some information is missing or isincorrect a service might not be activated.
If the end-user has providedincorrect information they MIGHT change it, if not any misuse is identified.Safestate AB does not take responsibility for the accuracy of the informationprovided.
When information has been provided and theservices have been activated the information for each service can NOT bechanged during the contract period to minimize misuse,

To change already registered information, theend-user must contact Safestate via the support (safestate.com/support) andprovide the information and reason. This is to be sure that the service is notmisused depending on the package/service level.
Through the automated serviceSAFESTATEDARKWEB, Safestate AB provides you with the ability to identifyexposed information on the Deep and Dark Web. The service enables you, as anend-user, to monitor and receive alerts when the company's assets are used aslogin credentials and subsequently appear in unauthorized locations. SafestateAB scans the web for leaked identities and verifies them against your domain,email address, or phone number. When exposed information is identified, youwill be notified via email alerts with details regarding the specific identitythat has been identified.
The service does not guarantee that allexposed information related to a domain, email, or phone number can be found oridentified.
The end-user is prohibited from searching forexposed information that does not belong to the enduser.
The service notifies the user wheninformation has been identified.

After the activation of the service theend-user may NOT change the search term within the contract period.
A website vulnerability scan primarily aimsto identify known technical vulnerabilities or weaknesses on a website. Knownvulnerabilities (CVEs: Common Vulnerabilities and Exposures) or weaknesses(CWEs: Common Weaknesses and Enumerations) are publicly recognizedvulnerabilities and/or weaknesses that vulnerability scanning tools often testagainst. Safestate's tools utilize the CVE/CWE system to search for andcategorize known vulnerabilities/weaknesses while also employing a range ofproprietary solutions to assess system security.
Safestate uses a vulnerability scanning toolto scan your website(s) for current vulnerabilities or weaknesses.
Upon completion of a vulnerability scan, areport is generated detailing the findings. The first section provides asummarized overview, while the second section contains more detailedinformation.
The service does not guarantee that allvulnerabilities or weaknesses will be identified.
The end-user is permitted to scan onlywebsites owned by the end-user.
Depending on the service level the end-usermay scan one or serval websites.
After the activation of the service theend-user may NOT change the website(s) term within the contract period.
SafestateCYBERINSIGHTS distributes importantnews and information regarding cybersecurity on a monthly basis, includingupdates on attacks, legislative changes, and more.
The service is distributed once permonth.
Depending on the service level the end-usermay add one or serval emails within the same domain that will receiveSafestateCYBERINSIGHTS.
After the activation of the service theend-user may change the provided emails within the contract period.
The end-user/receiver may NOT re distributethe SafetstateCYBERINSIGHTS without a written acceptance from Safetstate AB.
The end-user/receiver may NOT use theinformation from the SafetstateCYBERINSIGHTS for business purposes.
Safestate does not take responsibility forthe information provided in the distribution, and it is the enduser’s responsibility to handlethe information appropriately.
A blacklisting occurs, for example, when anemail domain is added to one or more blacklists. These blacklists are used byvarious organizations, such as Outlook, Gmail, and antivirus services, toautomatically block or mark communication as spam. To ensure that emails yousend are not blocked or marked as spam, it is essential to avoid being listedon a blacklist.
SafestateBLACKLIST conducts daily checks ofcertain blacklists and notifies the end-user via email if their domain is foundon a blacklist.
Notifications are sent the first time thedomain is listed or if it reappears after being removed.
The service does not guarantee that allblacklists are checked and that the services identify a blacklisting.
The end-user is permitted to check domainsowned by the end-user.
Depending on the service level the end-usermay check one or serval domains.
After the activation of the service theend-user may NOT change the domains(s) within the contract period.
Safestate TRIPPELCHECK verifies if a domainhas SPF, DMARC, and DKIM set up on its domain. These three settings are used toprevent email spoofing and enhance the security of email communication.
At the first check the end ser will benotified with the status (OK, NOT OK), and after the first notification theuser will only receive a new notification if something have been changed.
The service does not guarantee that all theSPF, DMARC and DKIM can be checked.
The end-user is permitted to check domainsowned by the end-user.
Depending on the service level the end-usermay check one or serval domains.
After the activation of the service theend-user may NOT change the domains(s) within the contract period.
4.1 You agree to indemnify and hold harmlessSafestate and its parent company and subsidiaries or affiliates and theirexecutive officers, managers, employees, donors, resellers, agents, andlicensees for and against all losses, expenses, damages and costs, including reasonable attorneys’fees, resulting from any violation of these Terms or thefailure to fulfil any obligations relating to your account incurred by you orany other person using your account. We reserve the right to take over theexclusive defence of any claim for which we are entitled to indemnificationunder these Terms. In such event, you must provide us with such cooperation asis reasonably requested by us.
5.1 Your privacy is very important to us, andtherefore we have created a separate Privacy policy to explain in detail how wecollect, manage, process, secure and store your private information. 5.2 Our Data Processing Addendum (“DPA”) supplements the Safestate Termsof Service, when the GDPR applies to your use of theSafestate Services to process User personal data. To read our DPA in itsentirety, please visit https://www.safestate.com/villkor/.
6.1. BY USING OUR WEBSITE OR SERVICES, YOUUNDERSTAND AND AGREE THAT ALL RESOURCES WE PROVIDE ARE “AS IS” AND “AS AVAILABLE”.THIS MEANS THAT WE DO NOT REPRESENT OR WARRANT TO YOUTHAT:
• THE USE OF OUR RESOURCES WILL MEET YOUR NEEDS OR REQUIREMENTS.
• USE OF OUR RESOURCES WILL BE UNINTERRUPTED, TIMELY, SECURE OR FREE FROMERRORS.
• THE INFORMATION OBTAINED BY USING OUR RESOURCES WILL BE ACCURATE ORRELIABLE; NOR THAT
• ANY DEFECTS IN THE OPERATION OR FUNCTIONALITY OF ANY RESOURCES WEPROVIDE WILL BE REPAIRED OR CORRECTED.
6.2. FURTHERMORE, YOU UNDERSTAND AND AGREETHAT:
• ANY CONTENT DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF OURRESOURCES IS DOWNLOADED OR OBTAINED AT YOUR OWN DISCRETION AND RISK; THAT YOUARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER OR OTHER DEVICES FOR
ANY LOSS OF DATA THAT MAY RESULT FROM THE DOWNLOAD OF SUCH CONTENT; ANDTHAT
• NO INFORMATION OR ADVICE, WHETHER EXPRESSED, IMPLIED, ORAL OR WRITTEN,OBTAINED BY YOU FROM SAFESTATE OR THROUGH ANY RESOURCES WE PROVIDE WILL CREATEANY WARRANTY, GUARANTEE OR CONDITIONS OF ANY KIND, EXCEPT FOR THOSE EXPRESSLYOUTLINED IN THESE TERMS.
6.3. UNLESS OTHERWISE EXPRESSED, SAFESTATEEXPRESSLY DISCLAIMS ALL WARRANTIES, GUARANTEE AND CONDITIONS OF ANY KIND,WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIEDWARRANTIES, GUARANTEE AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR APARTICULAR PURPOSE AND NON-INFRINGEMENT.
7.1 IN CONJUNCTION WITH THE DISCLAIMER OFWARRANTY AS EXPLAINED ABOVE, YOU EXPRESSLY UNDERSTAND AND AGREE THAT ANY CLAIMAGAINST US WILL BE LIMITED TO THE AMOUNT YOU HAVE PAID IN THE PREVIOUS 12MONTHS, IF ANY, FOR USE OF PRODUCTS AND/OR SERVICES. SAFESTATE WILL NOT BELIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY LOSS ORDAMAGE WHICH MAY BE INCURRED BY YOU AS A RESULT OF USING OUR RESOURCES OR AS ARESULT OF ANY CHANGES, DATA LOSS OR CORRUPTION, CANCELLATION, LOSS OF ACCESS ORDOWNTIME TO THE FULL EXTENT THAT APPLICABLE LIMITATION OF LIABILITY LAWS ALLOW.
8.1. All content and materials available atSafestate.com defined as the Resources, including but not limited to text,graphics, website name, code, images and logos and any derivatives thereto arethe intellectual property of Safestate or its third-party licensors (asapplicable) and are protected by applicable intellectual property law. Anyinappropriate use, including but not limited to the reproduction, distribution,display, or transmission of any content on this site is strictly prohibitedunless specifically authorized by Safestate (or the applicable third-partylicensor) in writing.
8.2. These Terms do not grant you anyownership interest in or to our Resources but only a limited right of use thatis revocable in accordance with these Terms or the Agreement. Safestate doesnot grant any license or other right to use any of our trademarks, servicemarks, copyrightable material, or other intellectual property except asexpressly provided in these Terms.
8.3. In addition, you agree to refrain fromany act which in any way compromises our Resources, including but not limitedto: (i) reverse engineering (except to the limited extent that applicable lawprohibits reverse engineering restrictions), reverse compiling, decrypting,disassembling or otherwise attempting to derive the source code of theResource; (ii) modifying, translating or creating derivative works of theResources; (iii) sublicensing, reselling, renting, leasing, distributing,marketing, commercializing or otherwise transferring rights or usage to theResources; or (iv) embedding the Resources in any third-party applicationsunless explicitly permitted.
8.4. Upon request from Safestate, you must beable and ready to confirm at any given time that you adhere to the provisionsof this clause. If you fail to deliver such confirmation within 15 working daysfrom receiving the request, this may be considered, at Safestate’s sole discretion, a materialbreach of these Terms.
9.1. This website and service is controlledby Safestate. By accessing our website, buying or using our services, you agreethat the laws of Sweden. Apply to all matters relating to the use of ourwebsite, use of the services and the purchase of any products or servicesthrough this site.
9.2. In the event of any dispute ordisagreement arising under or in connection with these Terms or the Agreement(including a dispute or disagreement as to the validity of the Terms or theAgreement or its formation), such dispute or disagreement will be referred toand resolved under the exclusive jurisdiction of the applicable court ofSweden.
If you receive Confidential Information ofSafestate or its affiliates you will, during the Term of this Agreement and fortwo (5) years after termination or expiry, keep the information confidentialand protect it using the same level of care and discretion that you use withrespect to your own confidential information, which will be in no case lessthan reasonable care and discretion. You will not use the ConfidentialInformation for your own purposes (other than implementation of this Agreement)or disclose it to any person other than your employees or Authorized Users whohave a need to know it and you will remain responsible for the confidentialityof the information. You will not use Confidential Information for any purposeother than as necessary to exercise rights or fulfil obligations under this
Agreement.“Confidential Information” means information of a confidential or proprietarynature (including trade secrets and information ofcommercial value), including without limitation, software, and underlyingtechnical or business information (including any user guides), which relates toSafestate that is disclosed or provided to you in connection with thisAgreement; provided, however, that Confidential Information does not includeinformation that (i) is or becomes a part of the public domain through no actor omission of you; (ii) was in your lawful possession prior to the disclosureand had not been obtained by the you either directly or indirectly fromSafestate; (iii) is lawfully disclosed you by a third party without restrictionon disclosure; or (iv) is independently developed by you. When this Agreementterminates or expires, you will destroy any Confidential Information ofSafestate or continue to keep it confidential.
11.1. If you have any questions or commentsabout these Terms of Service as outlined above, you can contact us atSafestate.com/support. If we need to send any notices to you, we may send themto the provided e-mail address.
11.2. This Terms, together with any sign-upform, agreement, policy, DPA, documentation, or guideline referenced in theseTerms, constitutes the entire agreement and understanding between you and uswith respect to the subject matter of this Agreement and the Safestate Service,superseding all prior or contemporaneous proposals, communications, andunderstandings, oral or written relating to that subject matter.
11.3. Any waiver of any provision of thisAgreement must be in writing and will not be deemed a waiver of any otherprovision. Waiver by one party of a breach of any provision of this Agreementby the other party will not operate as a waiver of any other or subsequentbreach by such breaching party.
11.4. This Agreement does not confer anyright or benefit on any person who is not a party to it and no one other than aparty to this Agreement, their successors and permitted assignees shall haveany right to enforce any of the terms of this Agreement.
11.5. Nothing in this Agreement is intendedto create a joint venture, partnership, agency, or employment relationshipbetween the parties.
